Services Description

Zyvexis Talent Solutions provides professional recruitment and staffing services, including but not limited to:

  • Bulk hiring and campus recruitment
  • Contract and temporary staffing solutions
  • HR consulting and workforce planning
  • Talent sourcing and screening
  • Career counseling for job seekers

We reserve the right to modify, suspend, or discontinue any part of our services at any time without prior notice.

User Accounts and Registration

Account Creation

To access certain features of our services, you may be required to provide personal information. You agree to:

  • Provide accurate, current, and complete information
  • Maintain and promptly update your information
  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activities under your account

Eligibility

For Employers

Service Agreement

When you engage our recruitment services as an employer, you agree to:

  • Provide accurate job descriptions and requirements
  • Respond to candidate submissions in a timely manner
  • Conduct interviews and hiring processes professionally and fairly
  • Pay agreed-upon fees for successful placements
  • Comply with all applicable employment laws and regulations
  • Not directly approach or hire candidates presented by us without our involvement

Fees and Payment

Recruitment fees are typically based on a percentage of the candidate's annual salary or as agreed in a separate service agreement. Payment terms will be specified in individual agreements. Late payments may incur additional charges.

Replacement Guarantee

We offer a replacement guarantee for permanent placements, subject to terms outlined in individual service agreements. This typically covers situations where a placed candidate leaves within a specified probation period.

For Job Seekers

No Fees for Job Seekers

Our services are free for job seekers. We do not charge candidates any fees for job search assistance, resume submission, career counseling, or placement services.

Job Seeker Obligations

As a job seeker using our services, you agree to:

  • Provide accurate and truthful information in your resume and applications
  • Update your profile and availability status regularly
  • Respond promptly to communication from us or potential employers
  • Attend scheduled interviews and inform us of any changes
  • Not misrepresent your qualifications, experience, or credentials
  • Notify us immediately if you accept employment through another channel

Resume and Profile

By submitting your resume or creating a profile, you grant us permission to:

  • Share your information with potential employers
  • Store your data in our database for future opportunities
  • Contact you regarding relevant job opportunities
  • Verify the information provided (with your consent)

Prohibited Activities

When using our services, you agree NOT to:

  • Violate any applicable laws or regulations
  • Provide false, misleading, or fraudulent information
  • Impersonate another person or entity
  • Harass, threaten, or discriminate against others
  • Use our services for any illegal or unauthorized purpose
  • Attempt to gain unauthorized access to our systems
  • Distribute spam, viruses, or malicious code
  • Scrape, copy, or use automated systems to access our content
  • Interfere with the proper functioning of our services
  • Circumvent our recruitment processes to avoid fees

Intellectual Property Rights

All content on our website, including text, graphics, logos, images, software, and compilation thereof, is the property of Zyvexis Talent Solutions or our licensors and is protected by Indian and international copyright, trademark, and intellectual property laws.

You may not reproduce, distribute, modify, create derivative works, publicly display, or exploit any content from our website without our prior written permission.

Disclaimer of Warranties

Our services are provided on an "AS IS" and "AS AVAILABLE" basis. We make no warranties, expressed or implied, regarding:

  • The accuracy, completeness, or reliability of information provided
  • The availability or uninterrupted access to our services
  • The suitability of candidates for specific positions
  • The success of job placements or recruitment efforts
  • The conduct or qualifications of employers or job seekers

We do not guarantee that our services will meet your specific requirements or that any placements will be successful or long-term.

Limitation of Liability

To the maximum extent permitted by law, Zyvexis Talent Solutions shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or business opportunities
  • Loss of data or information
  • Costs of procurement of substitute services
  • Damages arising from employer-employee relationships
  • Any other commercial damages or losses

Our total liability for any claim arising from these Terms shall not exceed the fees paid by you to us in the 12 months preceding the claim.

Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without cause or notice, including but not limited to:

  • Violation of these Terms
  • Fraudulent or illegal activity
  • Providing false information
  • Abusive or inappropriate behavior
  • Non-payment of fees (for employer services)

Upon termination, your right to use our services will immediately cease. We may delete your account and data, subject to our data retention obligations.

Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website with a new "Last Updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any disputes arising from or relating to these Terms or our services shall be subject to the exclusive jurisdiction of the courts in Ahmedabad, Gujarat, India.

Dispute Resolution

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be replaced with a valid provision that most closely reflects the original intent.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative.

We welcome your feedback and suggestions. Any feedback you provide becomes our property, and we may use it without any obligation to compensate you.
